a) This Website (www.ukparkingtickets.co.uk) is available to users for the purpuse of payments of parking charge notices (PCN’s) issued by or on behalf of UKPE (hereinafter referred to as the “User”, “Customer” or “You”), subject to these General Terms and Conditions (hereinafter referred to as “T&Cs”, “Terms”, “Terms of Use”). When you make payment(s) for a parking charge (PCN) on the Site or otherwise use this Site, you agree to accept these Terms and Conditions.

b) The User hereby declares that he or she is an adult (at least 18 years of age) and has the legal capacity to be bound by this agreement and to use this Website in accordance with these T&Cs. UK Parking Tickets expressly warns the User that by using this website to make a parking charge payment, he/she is concluding a contract with payment obligations. Furthermore, the User declares that all information he or she provides to access this Website and while using it is true, complete and accurate, and he/she agrees to keep it updated and aknowledges that he/she has fully read and accepts the website’s terms and conditions.

c) This Website is solely and exclusively for the User’s personal use for the payment of parking charge notices (PCN’s) issued by or on behalf of UKPE.

d) The User agrees not to use this Website for illegal or prohibited purposes and for payments of any parking charges/penalty charges (PCNs) that have not been issued by or behalf of UKPE. In particular, the User accepts that he or she will only use this Website for him/herself and the payments made through this Website will be only for parking charge notices (PCN’s) issued by or on behalf of UKPE.

e) The User shall not use this website to make or submit payment(s) for any parking charges, fines, penalty chrages or PCN’s issued to him/her by other car park operators, companies, land owners, agenst, local authorities and/or police.

f) The user agrees he/she is not using the Website on someone else’s behalf or he/she have the permission of the person for whom he/she is acting on and/or payments of “non UKPE” parking charge Notice’s (PCN’s).

g) UK Parking Tickets reserves the right to deny access to the Website at any time without any prior notice.

9.2 You agree to indemnify us fully, defend and hold us, and our officers, directors, employees and agents, harmless from and against all claims, liability, damages, error, accidental payment(s), losses, costs (including reasonable legal fees) arising out of any breach of the terms and conditions by you, or your use of this Website or Platform, or the use by any other person using your registration details.

9.3 We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.

9.4 You agree to fully reimburse us in respect of all losses, costs, actions, claims and liabilities incurred by us as a result of any breach of these User obligations or any data submitted by you to Us or to you by Us, otherwise than in accordance with these terms and conditions.

9.5 In addition to what is set out in the Terms and Conditions, you are responsible for all chargebacks, reversals, errors, fees, fines, penalties and other liabilities incurred by a third party or us caused by your access to and use of the Payment Service and/or arising from any breach by you of any provision of these Terms and Conditions. You agree to reimburse such third party or us for any and all such liability.

9.6 Notwithstanding the above or any other provision of these Terms and Conditions and in addition to what is set out in the Terms and Conditions, you agree to defend, indemnify, and hold us, our Acquirers, the Card Schemes and each of our respective directors, agents, affiliates and representatives harmless from and against any claim (including all third-party claims), cost, suit, demand, loss, liability, damage, action, proceeding judgment, penalty, interest and expense (including without limitation reasonable solicitor and legal fees) arising out of or relating to: a) any actual or alleged breach by you of any provision of the Card Scheme Rules, b) any payment transaction submitted by you through the Payment Service, and c) third party indemnity obligations we incur as a direct or indirect result of your acts or omissions (including indemnification of any Acquirer or Card Scheme).

9.7 You may not assign, sub-license or otherwise transfer any of your rights under these terms and conditions.

9.8 If any provision of these terms and conditions is found by any court of competent jurisdiction to be invalid, the invalidity of that provision will not affect the validity of the remaining provisions which shall continue to have full force and effect.

9.9 Only the parties to these terms and conditions may seek to enforce them under the Contracts (Rights of Third Parties) Act 1999.

10. In no event will UK Parking Tickets be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from your use of the online payment facility. Nothing in these terms will limit our liability for death or personal injury caused by UK Parking Tickets’ negligence or fraud.

10.1 By using our website you agree to be legally bound by these terms, which shall take effect immediately on your first use of our website.

10.2 We do not accept any liability whatsoever if you make a ‘parking charge payment’ in error for any parking charges that we did not instruct or ask or authorised you to make or to use this Site/Platform where you are not authorised to do so in contrary to our terms and conditions.

10.3 We have no liability for transactions that are incorrect as a result of inaccurate data entry, error and in the course of the use of the Service or for loss of data or information caused by the User.

10.4 If you owe us any amounts due, we may immediately collect such amounts from any funds held or maintained by us on your behalf. If there are insufficient funds to cover your liability, you agree to reimburse us immediately on demand through other means.

11. PARKING CHARGE PAYMENTS

11.1 We accept no liability whatsoever for any accidental payment(s) or any error made by the User whilst using this website. You are advised to read and check all the information provided on this website carefully prior to making/submitting any payment(s) in relation to payment of parking charges. You accept that any payments made in error by using this website and/or (not in accordance our terms and conditions) create a financial loss for Us, therefore accordingly you agree to pay us an administration fee. ‘Administration Fee’ is our fees raised for investigations due to errors made by the user resulting in administrative costs or arising out of any breach of the terms as set out on our website.

11.2 No Refunds are available once a Parking Charge is paid nor are you able to Cancel once your payment has been received. Refunds are strictly subject to our sole discretion and are subject to a ‘refund administration fee’ in accordance with the terms and conditions.

11.3 In the event of any accidental payment(s) or error or using this website/platform to pay/submit payments for parking charges that have not been issued by the UK Parking Enforcement ‘UKPE’, you may still be charged and the payment may not be refundable and you further accept and agree to indemnify us for our costs or losses associated by the user’s own error and breach of the terms and conditions and you further agree and accept to pay us a non-refundable administration fee and costs in consideration of any accidental payment(s) or error or failure to comply with the terms and conditions.

11.4 In the event of any payment(s) submitted/made by the User in error by using this website in contrary to our terms and conditions, the User accepts and agrees to pay us an ‘administration fee £100’ to cover our expenses related to additional administrative costs, this is also referred to as an “administrative fee”, you further accepts and agrees to pay us our costs in the event of chargeback (if applicable). We will not accept liability whatsoever for any losses or damages in any such circumstances.

11.5 By using this website and/or submitting payment(s) you further agree to abide by all of the ‘Terms and Conditions’ and agree that you have read and understood the information detailed within this agreement and associated schedules and agree to all of the terms set out therein.

11.6 Non-payment of a Parking Charge that is issued by the UK Parking Enforcement ‘UKPE’ may result in additional charges which will be added to the value of the costs including court fees, legal costs but not limited to and for which you will be liable on an indemnity basis and in the event that there is an error taking payment including but not limited to: your card failing (for example fraud tests or for insufficient funds), the card company or bank failing to process correctly or a failure on our side by making a payment in error, you will be liable for the cost of your payment submission, and, additionally should you make a payment in error, you agree to assume our costs the amount of our services together with our administration fee (£100) and any applicable interest at the above the bank of England’s base rate until time of payment.

12. CONTRACTUAL SET-OFF

12.1 By using this website you consent and agree that we shall be entitled to ‘set-off’ all cost incurred and loss and expense where it is expressly provided under selected Clauses;

12.2 Clause a): Failure of customer/user to comply with the website’s terms and conditions (‘the Contract’): If the customer/user does not adhere/comply with any parts of the website’s terms, the customer consent and agrees to pay us our costs and such costs shall be set-off against the customer by us.

12.3 Clause b): Fees Levies, Charges: If the customer/user fails to comply with any part of this website’s terms and conditions, the customer/user consent and agrees that we are entitled to remedies under Contract, to collect our costs from the customer/user which includes our administration costs, chargeback fees and any other associated costs from the customer/user and the costs shall be set-off against the customer/user by us.

12.4 Clause c): Parking Charge Payments: The user consent and agrees to indemnify us in the event of any accidental payment(s) in relation to a payment of parking charge notice (PCN) is not issued by UKPE. The user accepts and agrees that this website must not be used for the payment of parking charges/penalty charges issued by any other companies/local authorities/police and the user further accepts that the User is not authorised to use this website to make any payment for parking charge notice/penalty charge notice and/or any other chargers except UKPE’s parking charge notices (PCN’s). In the event of any accidental payment(s) made by the user and/or the unauthorised use of this website or breach of the terms and conditions of this website, the user consent and agrees to pay us our costs and such costs shall be set-off against the customer by us.

13.5 Clause d): The customer/user consent and agrees to fully reimburse us in respect of all losses, costs, actions, claims and liabilities incurred by us as a result of any breach of these user obligations or any data submitted by you to Us, otherwise than in accordance with these terms and conditions. The customer/user consent and agrees to pay us our costs and such costs shall be set off against the customer by us.

14.6 Clause e): The user consent and agrees that we shall be entitled to our administration costs, chargeback costs and all of our costs incurred as a result of the user’s failure to comply with the website’s terms and conditions and we shall further be entitled to set-off our costs against the user’s any available funds (if applicable) on our system or any third-party, user’s bank account or building society and such costs shall be set-off against the user’s account.

15.7 Clause f) In the event that any part of this Contract is breached by the user or terminated, you accept and agree to pay us our costs and no portion of any payments of any kind whatsoever previously provided hereunder shall be owed or be repayable or refunded to the user and such costs shall be set-off against the user by us.

15.8 Clause g) In the event that the User breaches any part(s) of this Contract and payment is made otherwise than in accordance with the terms and conditions, the credit balance arising may be used by us to offset any debt or outstanding invoice on the user’s account (whether arising from administration fees, costs, or any other legitimate charge). The credit balance will be offset against the user’s outstanding balance and such costs shall be set off against the user’s account by us.

16. GOVERNING LAW AND JURISDICTION

16.1 These terms and conditions shall be governed by and construed in accordance with English Law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts.
